Documents required

Collected once, digitally. We check the whole set before anything is filed — document problems are what turn a two-week job into a six-week one.

The mark

  • Logo file, where the mark is a device or stylised text
  • Description of the goods or services supplied under the mark
  • Date of first use, with proof, if already in use

The applicant

  • PAN and Aadhaar for an individual or proprietor
  • Incorporation certificate or partnership deed for an entity
  • Udyam certificate, to claim the concessional fee
  • Signed Form TM-48 authorising us to act

Questions

Q1What is a trademark class?

Goods and services are divided into 45 classes under the Nice Classification. Protection extends only to the classes you register in, so filing in the wrong class leaves the mark you actually use unprotected.

Q2What do the government fees come to?

Charged per class per mark, with a concessional rate for individuals, startups and MSME-registered entities. We confirm the exact amount applicable on the date of filing in your written quote.

Q3How long does it take?

You may use ™ from the day of filing. Registration typically takes 12 to 24 months where the application is not objected to or opposed.

Q4Can I register a name someone else is already using?

Usually not, if they got there first in the same or a similar class — and attempting it invites opposition. The search exists precisely to find that out before you spend money.
